1.1.1 SPS-Switzerland Payroll Services SA Privacy Principles

When you send your personal data to SPS-Switzerland Payroll Services SA (hereinafter referred to as ‘SPS’), you give SPS permission to use this information for its personnel placement activities. SPS will treat this information confidentially and will only disclose it to third parties within the scope of its personnel placement activities. 

With this privacy policy, we would like to provide you with the necessary information on data protection in accordance with the Federal Data Protection Act (DPA), the General Data Protection Regulations (GDPR) and other applicable legal provisions.

The purpose of this privacy notice on data protection provides information on the purposes and manner in which SPS processes personal data, who has access to this data and to whom the data is transmitted. We also inform you about your rights with regard to personal data.

The responsible entity for the purpose of the DPA is Interiman Group Services SA, Av. des Baumettes 5/7, 1020 Renens (hereinafter referred to as “IGS”).

Our various tools are secured against loss, destruction, theft, disclosure or modification of data by unauthorized persons. Our various data spaces guarantee confidential treatment and are only accessible with a personal username and password.

SPS points out that data transmission over the Internet (e.g., when communicating via e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.

1.1.2   What data do we collect?

We record your contact information (name, postal address, e-mail address and telephone numbers).

As a user of our sites or applications, we record information about your usage (IP address, date and time, service requested, etc.), and we also record cookies. If you have a personal account, we record the information necessary for this purpose, such as login and password. For more information, we urge you to consult our Cookie Policy for each site or app concerned.

We also record the necessary information, generally contained in a CV, when it is necessary to create an account or to complete the application process. This information is as follows:

For candidates who register and submit their file

  • Your date of birth, gender, nationality and settlement permit
  • Your professional qualifications that you have sent us on your CV, useful for a possible position
  • If you provide us with them, your photo, excerpts from the criminal record and from the register of prosecutions

For employees who carry out or have carried out an assignment

  • Your bank details, your AVS/AHV number and the information on your identity document.
  • Contractual, salary, tax or other information necessary to process your contract and to enable us to fulfil our obligations as an employer (hours worked, vacations, sickness, accident, etc…
  • If you provide us with them, the contact information of the people to contact in case of emergency

The data processing also applies to sensitive data within the meaning of Art. 3c of the Federal Data Protection Act (DPA) or to special categories of personal data within the meaning of Art. 9 of the GDPR. Sensitive data include political opinions, religious beliefs, physical or mental health or a photo showing ethnic origin. If you provide such information in your application documents, you expressly agree that we may store, process and transmit such information, in confidence, for strictly professional purposes.

 

1.1.3   What do we do with this information?

We carry out all our treatments on legal bases, corresponding to one of the following categories:

  • Your consent by means of a signed document (consent, registration form, assignment contract, framework contract)
  • Compliance with a legal, regulatory or contractual requirement (such as to guarantee the processing of your wages or social security contributions)
  • Our legitimate interests, described in the following section
  • We use your personal data in order to :
  • Manage our contracts with you,
  • Salary and payment in advance or wages
  • Manage our customer-supplier relations when we propose your file
  • Depending on for example sending you promotional material, mailings, newsletters, or alerts about open positions
  • Carry out direct marketing activities such as promotions, offers, surveys, contests, contests, newsletters, market research, satisfaction surveys or special events
  • Create and manage your accounts on our sites and applications
  • Protect us against fraud and other illegal activities by seeking to identify and prevent them, and in the event of lawsuits or other claims; and

In addition to the activities listed above, if you are a candidate or temporary worker, and you have an account on our sites or have applied through one of our sites, we also use your personal data, always in a confidential manner, to :

  • Assess your suitability and qualifications as a candidate for a possible position
  • Provide you with employment opportunities and work
  • Provide you with HR services, including benefit programs, assignments, payroll, performance management and disciplinary measures.
  • Provide you with additional services, such as training, career counselling and career transition services, with the help of our different companies
  • Perform statistical data analysis, such as analyzing our applicant and temporary worker base; assessing individual performance and capabilities, including rating job-related skills; identifying skill shortages; matching individuals to potential job opportunities; and analyzing “pipeline data” (trends in hiring practices).

We may also use your information for other purposes, provided that we specifically inform you of this no later than at the time the information is recorded. Your consent to such use will always be sought.

 

1.1.4      What are our legitimate interests?

  • SPS’s interests are personal information for legitimate business purposes, including :
  • The identification and prevention of fraud;
  • Improving the security of our network and information systems;
  • Analyzing, optimizing, developing or generally modifying our services;
  • The better understanding of our visitors’ interactions with our websites;
  • Direct marketing purposes, as well as measuring the efficiency of promotional and advertising campaigns
  • Sending postal communications that we believe will be of interest to you.

Whenever we process data for these purposes, we take great care to ensure that your rights are considered and respected. You have a right of revocation at any time.

 

1.1.5   How long do we keep your data?

We keep your personal data in our systems for as long as necessary for our processing and to fulfil our legal obligations.

 

1.1.6   What do we share?

We do not disclose the personal information we collect about you except as described in this Privacy Policy or in specific clauses provided in connection with specific activities with your consent.

In order to ensure the proper administration of our services, we may share your personal data with our suppliers, who perform services on our behalf and only on the basis of our instructions. Our suppliers are contractually bound by Interiman Group Services to maintain confidentiality and to comply with data protection laws. In addition, we do not authorise these suppliers to use or disclose your personal data except to provide such services on our behalf or to comply with legal requirements.

We may also share your personal data with (1) our affiliates; (2) if you are a job candidate, with our clients who may offer opportunities; and (3) with other people we work with, such as employment consultants or contractors, to find you employment.

In addition, we may disclose personal data about you (1) if we are required to do so by law or legal process; (2) to law enforcement authorities or on the basis of a legal request for disclosure; and (3) when we believe disclosure is appropriate to prevent personal injury, damage or financial loss, or in connection with the investigation of suspected illegal or fraudulent activities.

 

1.1.7       Your rights?

The “right to information” allows you to access your personal data stored by SPS at any time. You also have a “right to correction” of these data. This means that you have the right to correct or complete incorrect or incomplete personal data. Finally, you have a “right of deletion”, which allows you to request us to delete or restrict your stored personal data to the extent compatible with the fulfillment of our legal or contractual obligations.

In addition, you can revoke the declaration of consent given at any time. This revocation, however, only applies to the future. Thus, such a declaration does not affect the legality of the processing carried out up to the day of revocation.

This Privacy Policy may be updated at any time to reflect changes in our privacy practices or legal framework. In the event of a material change, we will endeavor to notify you, including by posting a message on our website. In all cases, we recommend that you check the version of this clause, the one published on our website being the authentic version.
